Terms of Service
1. Acceptance of Terms
By accessing, downloading, purchasing, or using any of our applications, websites, or services (collectively the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access or use the Services.
2. Description of Service
Our applications provide professional tools for photographers, digital technicians, and other creative professionals. Each application is offered through the Mac App Store, through direct purchase from this website, or both. Product-specific terms (pricing, trial duration, license activation limits, refund eligibility) are described on the relevant product page and any associated Refund Policy.
3. License Grant
We grant you a non-exclusive, non-transferable license to install and use our applications on the number of devices specified for your purchase channel. App Store licensing is governed by Apple’s End User License Agreement. Direct purchases are licensed per the activation limits described on the product’s pricing page.
4. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of BVG DIGITAL, LLC and its licensors, protected by copyright, trademark, and other applicable laws.
5. User Content
You retain all rights to any files, folders, or other content you process with our applications. Our applications operate locally on your device and we do not receive, access, or transmit your files or their contents.
6. Termination
We may suspend or terminate a license issued through direct purchase if a chargeback, refund, or material breach of these Terms occurs, in which case the application’s licensed features will become unavailable. App Store licenses are governed by Apple’s terms.
7. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, except those that cannot be excluded under applicable law.
8. Limitation of Liability
In no event shall BVG DIGITAL, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, except where such liability cannot be excluded by law.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions, except where mandatory consumer protection laws of the user’s country of residence apply.

Privacy Policy
Our applications process your files locally on your device. We do not access, transmit, or store the contents of your folders, files, or comparison results. The disclosures below describe the limited information we receive in connection with purchase and license enforcement.
Apps distributed through the Mac App Store
Apple handles all purchase, account, and download data under their privacy policy. We receive only anonymized aggregate sales statistics from Apple.
Apps purchased directly from thedigi.tech
When you purchase a license, our payment processor FastSpring (Bright Market, LLC dba FastSpring), the merchant of record, collects the billing information necessary to complete your transaction under their privacy policy. To enforce per-license activation limits and provide trial and refund support, our servers process your license code, a per-device identifier, and standard request metadata (IP address, user agent) when the application contacts our licensing API. We retain this information for the duration of your license plus the period required to handle refunds and to meet tax and accounting obligations.
Information Sharing
We do not sell or rent personal information. We share information with FastSpring and Apple only to the extent necessary to process purchases, deliver licenses, and comply with applicable tax law. We may also disclose information when required by law or to protect our legal rights.
Data Security
We use commercially reasonable measures to protect the limited information we hold against loss, misuse, unauthorized access, and disclosure.
Children’s Privacy
Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13.

Purchase data handled by Apple or FastSpring is processed under their respective privacy policies. In the past twelve months we have received the categories of personal information described in the Privacy Policy (identifiers and commercial information) for the purposes of fulfilling purchases and enforcing licenses.
