Terms of Service

1. Acceptance of Terms

By accessing, downloading, purchasing, or using any of our applications, websites, or services (collectively the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access or use the Services.

2. Description of Service

Our applications provide professional tools for photographers, digital technicians, and other creative professionals. Each application is offered through the Mac App Store, through direct purchase from this website, or both. Product-specific terms (pricing, trial duration, license activation limits, refund eligibility) are described on the relevant product page and any associated Refund Policy.

3. License Grant

We grant you a non-exclusive, non-transferable license to install and use our applications on the number of devices specified for your purchase channel. App Store licensing is governed by Apple’s End User License Agreement. Direct purchases are licensed per the activation limits described on the product’s pricing page.

4. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of BVG DIGITAL, LLC and its licensors, protected by copyright, trademark, and other applicable laws.

5. User Content

You retain all rights to any files, folders, or other content you process with our applications. Our applications operate locally on your device and we do not receive, access, or transmit your files or their contents.

6. Termination

We may suspend or terminate a license issued through direct purchase if a chargeback, refund, or material breach of these Terms occurs, in which case the application’s licensed features will become unavailable. App Store licenses are governed by Apple’s terms.

7. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, except those that cannot be excluded under applicable law.

8. Limitation of Liability

In no event shall BVG DIGITAL, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, except where such liability cannot be excluded by law.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions, except where mandatory consumer protection laws of the user’s country of residence apply.

11. Contact Us

If you have any questions about these Terms, please contact us.

Privacy Policy

Our applications process your files locally on your device. We do not access, transmit, or store the contents of your folders, files, or comparison results. The disclosures below describe the limited information we receive in connection with purchases, license enforcement, software updates, beta builds, and support requests.

Apps distributed through the Mac App Store

Apple handles all purchase, account, and download data under their privacy policy. We receive only anonymized aggregate sales statistics from Apple.

Apps purchased directly from thedigi.tech

When you purchase a license, our payment processor FastSpring (Bright Market, LLC dba FastSpring), the merchant of record, collects the billing information necessary to complete your transaction under their privacy policy. To enforce per-license activation limits and provide trial and refund support, our servers process your license code, a per-device identifier generated by the application, the name of your Mac as set in macOS, and standard request metadata (IP address, user agent) when the application contacts our licensing API, including when it re-checks your license or trial from time to time while it is open. When you start a free trial, the application also sends a one-way hash derived from your Mac’s hardware identifier so that the trial is offered once per Mac; the hardware identifier itself is not transmitted. We retain license information for the duration of your license plus the period required to handle refunds and to meet tax and accounting obligations. We keep trial and beta records so that a free trial is offered only once per Mac and so we can help with support questions; you can ask us to delete them at any time through our contact form.

Software updates (direct version)

The version of our applications downloaded from thedigi.tech checks for updates using the Sparkle update framework. It checks automatically about once a day, and you may also check manually at any time. Each check retrieves an update feed from our server, and installing an update downloads the installer from our server. These requests carry standard request metadata (IP address, and a user agent that identifies the application and its version). The application does not send system profile information with update checks. If you choose to receive beta updates, that choice is applied within the application and is not sent to our server. We use this information only to deliver updates and to operate and secure our server.

Beta builds (direct version)

If you install a beta build, the application requests a beta permit from our licensing API when it launches. The request contains the beta’s identifier, the per-device identifier generated by the application, and the name of your Mac. Our server records this information together with the time of the first and most recent request and standard request metadata (IP address, user agent). We use it to unlock the beta build while the beta is open and to count beta participants. Stable releases do not make this request.

Contact form

When you send a message through the contact form on this website, we receive the first name, last name, email address, and message you enter, and a Final Pass support bundle if you attach one. The message and any attachment are sent to us by email through our email provider; they are not stored on this website. We use this information only to respond to your inquiry. Submitting the form does not subscribe you to any mailing list.

Support bundles

Our applications can export a support bundle at your request. The bundle is saved as a file on your Mac and contains the application’s session logs and, in the version downloaded from thedigi.tech, recent crash reports for the application. Logs may include the names and locations of folders you compared; your macOS user name is removed from them. The application never sends a support bundle on its own. We receive one only if you choose to attach it to a message on our contact form, and we use it only to resolve your support request.

Information Sharing

We do not sell or rent personal information. We share information with FastSpring and Apple only to the extent necessary to process purchases, deliver licenses, and comply with applicable tax law. We may also disclose information when required by law or to protect our legal rights.

Data Security

We use commercially reasonable measures to protect the limited information we hold against loss, misuse, unauthorized access, and disclosure.

Children’s Privacy

Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date at the top of this page reflects the most recent revision.

GDPR Compliance (For EU/UK Users)

For EU and UK residents, our lawful basis for processing the limited information described in the Privacy Policy is the performance of a contract (delivering and enforcing your license) and our legitimate interest in preventing fraud and abuse.
